Contact and responsibility

Juergen Nogai is responsible for personal data processed in connection with this gallery and inquiries addressed to him.

Visiting the gallery and hosting

The gallery is hosted through ChatGPT Sites, provided by OpenAI, using Cloudflare infrastructure. Delivering the pages and images requires processing technical request information, such as IP address, requested URL, date and time, and browser information. Hosting providers may keep technical logs for service operation, security and troubleshooting.

The purpose is to deliver and protect the gallery. Where the operator processes personal data for this purpose, the legal basis is the legitimate interest in operating a reliable, secure website under Article 6(1)(f) GDPR.

Hosting and account services may process data outside the European Economic Area. The providers describe their processing, retention and international-transfer safeguards in their privacy information: OpenAI privacy policy and Cloudflare privacy policy. These services have their own responsibilities for their account and service data.

Cookies and browser storage

The gallery does not include advertising, visitor-analytics scripts or third-party embedded media. Its fonts are supplied locally or by your device; the gallery does not load fonts from Google.

If you save a work, the gallery stores its identifier in your browser’s local storage so that your requested saved-works list remains available on this device. This is a functional preference, not an advertising profile, and is not sent to the gallery server. You can clear it with “Clear saved works” or through your browser settings.

The optional archive task area stores your tasks in this browser when you add a task or change its status. These tasks are not sent to a shared task server. You can clear them with “Clear saved tasks” or through your browser settings. Browser storage has no automatic expiry; it remains until you clear it or your browser removes it.

These storage functions serve features you explicitly choose to use. Where storage is strictly necessary for the requested feature, Section 25(2)(2) TDDDG applies. Hosting and ChatGPT sign-in can additionally use technical cookies or session storage governed by their providers’ notices. See OpenAI’s cookie notice. The gallery itself adds no optional advertising or analytics cookies.

Email and telephone inquiries

The inquiry form prepares a draft on your device. Names, email addresses and messages entered in it are not submitted to the gallery database. The draft is sent only if you send it from your email application. A text download or clipboard copy is also initiated only when you select that option.

If you contact Juergen Nogai by email or telephone, the contact details and information you provide are used to answer your inquiry and, where relevant, discuss or carry out a sale. The legal basis is Article 6(1)(b) GDPR for steps you request before a contract or for carrying out an agreement; general correspondence is handled on the basis of the legitimate interest in answering inquiries under Article 6(1)(f) GDPR.

You decide what information to provide. Without a reply address or another way to contact you, an inquiry may not be answered. Correspondence may be handled through the operator’s email and communication providers; arranging delivery may require sharing the necessary delivery details with a carrier.

Correspondence is kept for as long as needed to handle the inquiry or agreement and comply with applicable retention obligations, or to establish, exercise or defend legal claims. Technical log retention is managed by the hosting providers. Inquiries are not saved in the gallery’s inventory backup system.

Sign-in and the protected workspace

Access to this website or its protected workspace may require ChatGPT sign-in. OpenAI manages the account and authentication process. The gallery does not receive your ChatGPT password. The protected workspace uses authenticated account identity, including account identifier and email address, to check permission to edit the inventory and access private backups. It does not create a separate customer registration database.

Your rights

Subject to the applicable legal requirements, you may request access to your personal data, correction, erasure, restriction of processing or data portability. You may object to processing based on legitimate interests on grounds relating to your particular situation. Where processing is based on consent, you may withdraw that consent for the future.

For data held by the gallery operator, contact Foto.JNogai@gmx.net. For data processed independently by your account, hosting or email provider, their privacy contacts are also available.

You may complain to a data protection supervisory authority, including the Bremen data protection authority, or the authority responsible for your habitual residence. The gallery operator does not use inquiry data for automated decision-making or profiling.
